From time to time, Chaplin Performance, LLC (“we,” “our,” or “us”) will collect, use, and disclose your information, including personal information. We recognize that your privacy is important. This Privacy Policy describes our policies on the collection, use, and disclosure of information about you in connection with your use of our website (the “Site”) and our programs, including but not limited to Movement Foundations, the New Neck Protocol, and any other programs offered in-person, through our Site, emails, or social media accounts (collectively, “Our Programs”).


When you use our Site or Our Programs, you consent to our collection, use, and disclosure of information about you as described in this Privacy Policy. You also acknowledge that this Privacy Policy is designed to be read in connection with our Site’s Terms of Use and that by accessing or using the Site or Our Programs, you agree to be bound by the Terms of Use and this Privacy Policy.


We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by updating any privacy information on this page. Your continued use of the Site and Our Programs after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy, and (b) agreement to abide and be bound by that Privacy Policy.

Personally Identifiable Information (“PII”)


This refers to information that lets us know the specifics of who you are. Examples include your first and last name and email address. You may also voluntarily provide other PII by contacting us via email or by posting publicly viewable comments on the Site. You agree that we may collect any PII voluntarily supplied by you, whether or not we have specifically requested it. You must not submit any PII relating to a third party unless you have permission to do so.




Aggregate Information


This refers to information that does not by itself identify a specific individual. We gather certain information based upon where you visit on our Site and what other sites may have directed you to us. This can include the URL of the website you came from, which URL you go to after visiting our Site, what browser you are using, and your IP address.




How We Collect and Use Information


We do not collect any PII about you unless you voluntarily provide it. However, you may be required to provide certain PII when you elect to use certain services on the Site.


We primarily use your PII to provide information and service offerings to you, including Movement Foundations, the New Neck Protocol, and other educational or coaching services. We may also use PII to:


  • Enhance the operation of our Site
  • Improve our marketing efforts
  • Statistically analyze Site use
  • Improve our offerings and customize the Site’s content and layout
  • Enforce our agreements, including our Terms of Use and this Privacy Policy
  • Deliver requested services or respond to your inquiries


We may also collect Aggregate Information such as IP addresses to help diagnose problems with our servers and administer the Site.


If your browser emits “do not track” signals or uses mechanisms to prevent the collection of data, we honor these signals.

How We Use Cookies

Other than our Service Partners, we do not allow outside parties to collect PII or Aggregate Information about you when using our Site.


We may also be required by law enforcement or judicial authorities to provide PII. We comply with court orders, subpoenas, and cooperate with investigations. We also reserve the right to report any activities we believe are unlawful.




Updating and Correcting Your Information


You may change your PII at any time by contacting us at [email protected]. Please include your name and email. You can also request to delete your account. We will complete your request within three business days. Note: some technical support records or backups may not be fully deleted.

Your GDPR Rights (EU Residents)


We strive to comply with the General Data Protection Regulation (GDPR). EU residents have the right to ask questions about their data, request corrections or deletion, and lodge complaints with the EU Commission if dissatisfied. Contact [email protected] for questions or requests.




Your Choices on Information Use


We may send you emails or newsletters about our programs, including the New Neck Protocol and other offerings. Only Chaplin Performance, LLC (or agents working on our behalf) will send these. You may opt-out at any time by clicking “Unsubscribe” in emails or contacting [email protected].


You can also modify cookie settings in your browser to control data collection.




Security of Your Information


We use industry-standard safeguards to protect your PII, including secure servers, encryption, firewalls, and restricted access. However, no data transmission over the Internet can be guaranteed 100% secure, and you acknowledge these risks.




Minors


You must be at least 18 years old (or be the guardian giving permission on behalf of a minor) to use our Site. We do not knowingly collect PII from individuals under 18.




Public Areas and Third Parties
